EcoTransIT World Terms & Conditions for the Download Portal
§ 1 Scope of Application
These Terms and Conditions govern the use of the EcoTransIT World Download Portal
(“Download Portal”) including an EcoTransIT World related Chatbot (“ETW Chatbot”). The
Download Portal and ETW Chatbot are owned and provided by the company IVE –
Ingenieursgesellschaft für Verkehrs- und Eisenbahnwesen mbh (“IVE mbH”).
The Download Portal is intended to provide registered users with access to support materials
created by IVE mbH. These materials include, but are not limited to, documentation, manuals,
webinar recordings, and other supplementary resources. The ETW Chatbot is an optional support tool available exclusively to users of EcoTransIT World. It utilises the Azure OpenAI Service provided by Microsoft to process user inputs. The Chatbot’s responses are primarily generated from internal documentation provided by IVE mbH and EcoTransIT World, such as manuals, methodology reports and similar content.
§ 2 Permitted Use
All content provided through the Services is for informational purposes and internal business
use only. It does not constitute legal, professional, or expert advice. Any use beyond this
defined scope, including but not limited to misuse, unauthorised redistribution, or exploitation
for unrelated purposes, is strictly prohibited.
§ 3 Copyright Attribution Obligation and Intellectual Property Rights
All materials provided by IVE mbH (including but not limited to manuals, methodology reports,
technical documentation, training materials, and presentations) are protected under applicable
copyright laws and remain the intellectual property of IVE mbH, unless otherwise stated.
Any alteration, removal, or suppression of copyright notices, logos, or source references is
prohibited. When such materials are lawfully shared or used, proper attribution to IVE mbH as
the copyright holder must be clearly maintained. Any reproduction, distribution, or other unauthorized use of the Portal content without prior written consent from IVE mbH is prohibited.
§ 4 Disclaimer of Liability
IVE mbH does not warrant the accuracy, completeness, or currency of the information provided
and users utilize given information obtained from it at their own risk. IVE mbH shall not be held liable for any direct or indirect damages resulting from the use or inability to use the ETW Chatbot or the information provided, except in cases of wilful misconduct or gross negligence.
§ 5 Amendments to the Terms and Conditions
IVE mbH reserves the right to amend these Terms and Conditions at any time. Changes shall
become effective upon publication via the Download Portal or related service interface.
Continued use of the Services following such publication constitutes acceptance of the revised
terms.
§ 6 Acceptance of Terms
By accessing or using the Portal and/or the Chatbot, the user acknowledges and agrees to be
bound by these Terms and Conditions. If the user does not agree to these Terms, they are not
authorized to use the Download Portal or the ETW Chatbot.
§ 7 ETW Chatbot Related Paragraphs
The Chatbot is provided solely as a support module to assist users by delivering information
derived exclusively from internal documentation of IVE mbH related to EcoTransIT World. It
does not constitute a standalone service, nor does it access or rely on publicly available
internet sources.
§ 7.1 Disclaimer of the ETW Chatbot
The ETW Chatbot utilises the Azure OpenAI Service provided by Microsoft (currently: Region
Sweden Central, Model GPT-4o-mini, Temperature: 0.2). IVE mbH has no control over, and
accepts no responsibility for, any data processing, storage, or logging performed by Microsoft
or its affiliates. Users should review Microsoft’s applicable terms of use and privacy policies,
which may change without notice. Continued use of the Chatbot constitutes acceptance of
such changes. The chatbot’s responses are primarily generated from documents provided by IVE mbH and EcoTransIT World (e.g. manuals, methodology reports and similar materials). As such, output
may be automatically generated, incomplete, outdated, or inaccurate, and must not be relied
upon as legal, financial, or professional advice. Users are strongly advised not to make
business or legal decisions based solely on Chatbot outputs. Users must refrain from submitting any confidential, sensitive, or personal data unless strictly necessary and lawful. Users are solely responsible for the legality of any data they provide including ensuring any required third-party consents.
To the extent permitted by law, IVE mbH shall not be liable for any loss or damage arising from
the use of the chatbot or from changes to or interruptions of Microsoft’s services. For questions

§ 7.2 Data Protection
The ETW Chatbot processes only the textual input submitted by users. User interactions
(questions and answers) may be reviewed internally by the IVE mbH team solely for the
purpose of improving the quality and performance of the ETW Chatbot. Such data will not be
disclosed externally and automatically deleted on a regular basis.
§ 7.3 Technology and Trademarks
The Chatbot utilizes the Azure OpenAI Service, a platform provided by Microsoft®. The
Chatbot is developed and operated by IVE mbH and is neither affiliated with nor endorsed by
OpenAI LP or Microsoft Corporation. “OpenAI” and “Microsoft” are registered trademarks of their respective owners. Use of the Chatbot is subject to the terms and conditions of the Azure OpenAI Service as defined and maintained by Microsoft Corporation. Users acknowledge and agree that their interaction with the Chatbot is also governed by Microsoft’s applicable terms, available at:

§ 8 Severability
Should any provision of these Terms and Conditions be or become invalid or unenforceable,
the validity of the remaining provisions shall not be affected. The invalid provision shall be
replaced by a valid provision that most closely reflects the economic intent of the original.
§ 9 Suspension and Termination of Access
IVE mbH reserves the right to restrict, suspend, or permanently terminate access to the
Download Portal and/or the ETW Chatbot in cases of misuse, breach of these Terms, or for
operational or technical reasons, without prior notice.
§ 10 Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws
of the Federal Republic of Germany. The exclusive place of jurisdiction for all disputes arising
out of or in connection with these Terms shall be Hannover, Germany.
